These terms cover your use of everchorus.com.au and our custom song service, operated by DSCC Solutions (ABN 29 637 412 046), Perth, Western Australia ("Everchorus", "we", "us"). By using our site or ordering a song, you agree to these terms.
How the service works
You tell us about someone you love through our quiz. We turn your story into original lyrics and email them to you for approval — nothing is recorded until you approve every word. We then produce your song using cutting-edge AI music production, review it personally, and send you a free preview. If you choose to purchase, the full song is delivered to your email with a download and a keepsake page. Rush Delivery targets 1–6 hours and Standard Delivery targets 48 hours from purchase; these are delivery targets we work hard to hit, not guarantees, though your rights under the Australian Consumer Law always apply.
Your responsibilities
You confirm that the details you submit are accurate and that you have the right to share them, including personal details about your song's recipient. Don't submit content that is unlawful, hateful, defamatory, infringing, or intended to harass anyone. We may decline, pause, or cancel a request that we reasonably believe can't be completed responsibly — if you've already paid and we cancel for this reason without delivering, we'll refund you.
Ownership and your licence
We (and our licensors) retain ownership of the musical composition, recording, and all intellectual property in your song. When you purchase, you receive a permanent, worldwide, personal, non-commercial licence to play, download, keep, and share your song with family and friends — including at private events and on your personal social media. Commercial use (advertising, monetised content, resale, streaming platform distribution) requires our prior written permission — email us; we're reasonable. The story details you submit remain yours; you grant us a licence to use them solely to create and deliver your song.
Revisions — we'll make it right
If something in your delivered song isn't right, tell us what and we'll fix it free of charge — we don't consider a song finished until you do. See our Refund Policy for full details.
How songs are made
Everchorus songs are crafted with cutting-edge AI music production from lyrics generated from your story, and every song is personally reviewed by a real person before delivery. You approve the lyrics before recording. Because each song is generated from your unique story, the final result may differ from what you imagined — that's what your lyric approval, free preview, and our make-it-right promise are for.
Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Competition and Consumer Act 2010 (Cth) or any other law that cannot lawfully be excluded. To the extent permitted by law, our liability for anything else arising from your order is limited to resupplying the song or refunding the amount you paid.
General
We may update these terms from time to time; the version on this page applies to your order at the time you place it. These terms are governed by the laws of Western Australia, and you agree to the non-exclusive jurisdiction of its courts. If part of these terms is found invalid, the rest still applies.
